We only collect information strictly necessary for the stated purpose.
For clients and users located in the European Economic Area (EEA), XSoftHub's processing of personal data is based on the following legal bases under the General Data Protection Regulation (GDPR): (a) Performance of a contract — processing is necessary for the provision of the contracted services; (b) Legitimate interest — for internal management, fraud prevention, security, and improvement of our services, provided that the rights and freedoms of the data subject do not override; (c) Legal obligation — when processing is necessary to comply with a legal obligation applicable to XSoftHub; (d) Consent — for marketing communications and the use of non-essential cookies, where the data subject's explicit consent has been obtained. XSoftHub does not sell, rent, or trade its clients' personal data. We share information with third parties only in the following circumstances: (a) Service providers — companies that assist us in service delivery (cloud infrastructure providers, communication tools, analytics), bound by data processing agreements that guarantee equivalent protections; (b) Stripe, Inc. — external payment processor that receives billing data necessary for transaction processing, subject to its own privacy policy (stripe.com/privacy); (c) Legal requirements — when required by law, court order, or competent authority; (d) Rights protection — when necessary to protect the rights, property, or safety of XSoftHub, its clients, or the public. All third parties are required to treat your data confidentially and only for strictly necessary purposes.
Personal data of our clients may be transferred to and processed in countries other than your country of residence, including countries outside the European Economic Area (EEA). In such cases, XSoftHub ensures that such transfers are carried out with appropriate safeguards in accordance with GDPR, including: (a) Standard Contractual Clauses (SCCs) approved by the European Commission; (b) European Commission adequacy decisions for the destination country; (c) Other appropriate safeguards under Article 46 of the GDPR. XSoftHub retains personal data only for as long as necessary to fulfill the purposes for which it was collected, including compliance with legal, accounting, or reporting obligations. General retention criteria are as follows: (a) Active client data — throughout the entire duration of the contractual relationship; (b) Completed project data — up to five (5) years after completion, unless legal obligations require a longer period; (c) Billing data — the minimum period required by applicable tax regulations (generally between 5 and 7 years); (d) Communication records — up to three (3) years after the last interaction.
